Arthrex SCOTUS Oral Arguments on Monday! We’ll Be Live Tweeting Updates

When oral arguments commence in United States v. Arthrex, Inc., No. 19-1434 (U.S.) on Monday, March 1, William H. Milliken, a director in Sterne Kessler’s Trial & Appellate Practice Group, will be live tweeting updates from the firm’s account, @sternekessler. Updates will begin at 10:00 a.m. and continue throughout the duration of the proceedings.

By way of background, in October 2020, the U.S. Supreme Court granted certiorari in Arthrex v. Smith & Nephew to review the Federal Circuit’s decision regarding the constitutionality of the appointment of USPTO Patent Trial and Appeal Board (PTAB) judges. Our October 14, 2020, client alert outlined analysis from Milliken highlighting what practitioners and litigants should know as the Supreme Court considers this case.

The firm will continue to provide updates and analysis on this case up to the Court’s decision and beyond.
