As the German Constitutional Court has declared Germany’s approval of the Unitary Patent Court void, the dream of a unitary patent in Europe is all but dead. Meanwhile, the United States continues to find itself embroiled in self-inflicted a patent eligibility crisis that may well be contributing to substantial unpreparedness to handle the COVID-19 pandemic.

Today, China is becoming one of the most favorable patent jurisdictions in the world, with an innovator friendly view of what is patent eligible and an improving litigation landscape. As litigation in the U.S. declines and continues to move overseas to Germany and increasingly to China, with Eastern preferences for out of court solutions and negotiations lead to mediation and arbitration becoming increasingly important for the disposition of patent infringement and associated trade disputes?
