In Arthrex, the Court concluded that APJs’ ability to render final decisions in inter partes reviews on behalf of the executive branch is “incompatible with their status as inferior officers.” In Minerva, the Court largely followed the Government’s suggested course, affirming the continued vitality of the doctrine but cabining its scope.
