“But William Milliken, partner at Sterne Kessler in Washington DC, says it’s hard to say which way the court is leaning.

However, he doesn’t expect the legal test for enablement to change much given that the parties seemed to agree on those standards.

‘It’s safe to predict that the court isn’t going to use this case to fashion an enablement test that’s completely different than anything we’ve seen before,’ he says.”
