Director Carla Ji-Eun Kim was quoted in the article “Raise your wands: counsel welcome USPTO’s enablement guidance,” published by Managing IP, regarding the United States Patent and Trademark Office’s guidelines in the wake of Amgen v Sanofi to preserve the Wands factors for determining patent enablement:
“Carla Ji-Eun Kim, chair of the patent prosecution practice at Sterne Kessler in Washington DC, says she did not expect the USPTO to say this.
She notes that attorneys knew that the principles outlined in Amgen applied to all fields. But it still wasn’t completely clear whether other sectors could face increased scrutiny over enablement issues.
“We’ll have to see how that plays out,” she says.”
