Washington, D.C. (December 23, 2024) – The U.S. Patent Trial and Appeal Board (PTAB) has upheld a patent belonging to Sterne, Kessler, Goldstein & Fox client Netlist, a leading innovator in advanced memory and storage solutions.

Sterne Kessler Director Richard Bemben, co-chair of the firm’s PTAB Practice, argued the case as lead counsel before the PTAB, which upheld the company’s U.S. patent no. 10,268,608 and found it not to be invalid. The patent was part of a jury verdict last month in the U.S. District Court for the Eastern District of Texas (EDTX) where Netlist won a $118 million damages award against Samsung. Hong Annita Zhong and Jonathan M. Lindsay from Irell & Manella acted as co-counsel in the PTAB proceeding.
