Sterne, Kessler, Goldstein & Fox announces that it has successfully defended G+ Communications LLC in an ex parte reexamination (Case No. 90/019,347) filed by Samsung Electronics against U.S. Patent No. 8,761,776 (’776 patent) seeking the cancellation of claims for a wireless network patent. In a Notice of Intent to Issue a Reexamination Certificate, the U.S. Patent and Trademark Office upheld the validity of all challenged claims.

The Patent Office’s decision follows a related federal district court litigation in the Eastern District of Texas where G+ Communications sued Samsung Electronics for patent infringement (Case No. 2:22-cv-00078-JRG). In the litigation, the jury found claims 1 and 2 of the ‘776 patent valid and infringed, and awarded G+ Communications $61 million. The Court entered its final judgment on July 3, 2024.
