US Supreme Court Gives PTO Director Chance To Impact Outcome Of Patent Disputes

Director William H. Milliken was quoted in the article “SCOTUS Limits Patent Judges’ Power but Preserves PTAB Review,” published by Pink Sheet. He commented on the US Supreme Court’s decision in United States v. Arthrex, Inc. that was issued on June 21, 2021. From the article:

“William Milliken, a director at Sterne, Kessler, Goldstein & Fox, said it remains to be seen how the new layer of review will affect PTAB practice. ‘I don’t see it as being decidedly in favor of one side or another’ in an IPR proceeding, he stated. He also noted that the PTO is expected to issue guidance in the near future on how to implement director review.”
