The PTAB Bar Association’s Committee on Appeals from the PTAB has announced the release of the 2020 Appellate Year in Review. The organization notes that this annual publication summarizes the most important decisions of the year involving appeals from the PTAB. The authors put these decisions into context and discuss their impact on PTAB practice. Reader access for the 2020 Appellate Year in Review is restricted to PTAB Bar Association members, but it can be accessed, along with past editions from 2018 and 2019, here.
Sterne Kessler Director Pauline M. Pelletier served as Editor-in-Chief for 2020 Appellate Year in Review. Summarizing this year’s contributions, she shares in her Letter from the Editor that, “The 2020 appellate year presented some unique topics that have not been addressed in past years. In this edition, our authors provide insights into developments in PTAB practice, including patent-eligibility challenges to motions to amend, joinder practice, nexus for secondary considerations, assignor and statutory estoppel, and fees and sanctions at the PTAB.” In addition to serving as the Editor-in-Chief, Pauline also authored the article titled “Bringing Arguments in a Timely Manner.”
Furthermore, Director Jon E. Wright authored the article titled “APA Compliance Reviewed on Appeal,” and served as a member of the editorial board for the Year in Review.
