Overview
Davin B. Guinn is an associate in Sterne Kessler’s Trial & Appellate Practice Group. Davin has represented numerous parties in patent litigation matters before the U.S. International Trade Commission and federal district courts, including multiple Section 337 investigations and exclusion order enforcement proceedings before the Exclusion Order Enforcement Branch of U.S. Customs and Border Protection. He has litigated cases involving a diverse array of technologies, including consumer products, construction machinery, food packaging and processing equipment, and pharmaceuticals.
Davin has extensive experience across a broad spectrum of litigation proceedings, including hearings and trials, fact and expert discovery, taking depositions, preparing expert witnesses, performing validity and infringement analyses, assessing claim construction positions, and drafting briefs and motions. A growing part of Davin’s practice includes analyzing various litigation elements unique to Section 337 investigations, including the economic prong of the domestic industry requirement, bond analysis, inventory, and remedial order enforcement.
While studying at the J. Reuben Clark Law School, Davin joined the Student Intellectual Property Law Association and served on the board for the BYU Law Trial Advocacy team. He participated in the inaugural NITA BYU Law Trial Academy and was the winner of the BYU Law Proximate Cause Storytelling Competition. Davin graduated from Brigham Young University as the valedictorian of the political science major. During his time at Brigham Young University, Davin was a member of the BYU Division I Men’s Basketball team and was selected to the West Coast Conference All-Academic Team for the 2016-2017 season. In his final year, he received the BYU Basketball Inspirational Player and Academic Excellence awards.
