Julie Shirk joined Sterne Kessler in 1989, and is a seasoned intellectual property professional. Her trademark practice focuses on clearing, procuring, licensing, and enforcing trademark rights, with a particular emphasis on trademarks and trade dress for the pharmaceutical and consumer products industries. Julie has experience with Opposition and Cancellation matters before the Trademark Trial and Appeal of the U.S. Patent and Trademark Office, including the drafting of settlement and coexistence agreements, and she provides support for actions brought before the federal courts.
In the online realm, Julie monitors third-party websites for infringement and drafts user agreements, terms of use, and other website-specific policies. She handles a wide range of trademark and domain name disputes, drafting and filing complaints under ICANN’s Uniform Dispute Resolution Policy and other rights protection mechanisms, and negotiating and drafting resolutions to such disputes.
Julie has worked with clients to avoid false advertising issues, particularly in the area of claims substantiation, and she has procured numerous copyright registrations for clients in various industries.
With her degree in marketing, Julie is able to meld her trademark experience with her knowledge of real-world consumer communication and product life-cycle issues to achieve clients’ business objectives.
